Articles Commenced Prior to 01 July 2008

Articles of Clerkship

Once an applicant secures Articles of Clerkship, they should contact their university, where they obtained their LL.B. and request an academic record be sent direct to the Board of Examiners office by registered mail. Applicants should ensure that their university promptly provides the necessary academic transcript, and that it shows clearly the precise date on which the qualification was completed. At this point applicants do not need to have graduated. However, applicants must have formally graduated before admission, and this stipulation is strictly enforced, for a number of cogent historical reasons*. *The exception being Monash LL.M.(LP) students.

No academic record will be accepted by mail or by hand from an applicant, or their agent, under any circumstance.

Lodging your Articles Documentation

Articles of Clerkship generally run for a period of 12 months. Applicants may apply for an abridgement of articles after serving a period of clerkship of between five and six months. For further information regarding dispensation or abridgement, it is advised to contact the Board direct.

Applicants will not be contacted, either before or after approval of articles, unless there is a problem.

Supplementary Articles

Any applicants having to change their Principal (for whatever reason) throughout their term of articles, must file Supplementary Articles with the Board office, at least one month from the date of signing the necessary documentation. Any period of time from leaving the first Principal and commencing with the subsequent Principal (other than weekends and/or public holidays) will be counted towards the applicant's holiday leave, if there is no continuity in signing the Supplementary documents.

Termination of Articles

The applicant must arrange for a letter to be signed by both himself/herself and the Principal, agreeing to the termination of the articles on a specific date. The letter should then be filed with the Board of Examiners.

Employment during Articles

If clerks undertake any form of employment during their term of articles (outside the ordinary hours of business), they must seek the written consent of their Principal. The letter should then be filed with the Board of Examiners' office. If the employment is during ordinary business hours, the clerk must obtain the written consent of the Principal and the approval of the Board.

Notice of Intention (Schedule 6) - All Applicants

Applicants can lodge their Notice of Intention prior to completing articles. This must be lodged with the Board office not less than one month before the date of admission. [Please refer to the Admission Scheduled Deadline Date Calendar to ascertain eligibility for particular admission dates].

Aplicants must file the original with the Board office and pin a copy on the notice board in the old High Court Building. Those applicants outside the metropolitan area may lodge their documents by mail and will receive further advice.

Upon lodging the Notice of Intention, applicants will be handed memos regarding fee payment times, amounts, and procedures. Any applicants failing to pay the fees by the required time will have their name taken off the list and ultimately have their admission deferred until the fees are paid.

Whilst attending the Board of Examiners' office, applicants will be informed as to what further documentation they need to annex to their affidavit.

All Applicants must ensure that an Annexure Sheet (Exhibit Note) is placed before each document attached to the affidavits. You must lodge documents as follows:

  • Schedule 7 - Principal's Affidavit - This form is to be filled out by Articled Clerks as a Principal's Affidavit of Service under Articles.
  • Schedule 8 - Local Applicants or Qualified Overseas Applicants - Affidavit in Support of Application for Admission - This form is to be filled out by Articled Clerks as an Affidavit in support of Application for Admission.
  • Schedule 9 - Affidavits as to Character - This form is to be filled out for Articled Clerks as an Affidavit as to Character, by a witness to verify the Articled Clerk's character and identity. [Note: 2 Affidavits to Character must be lodged]
  • Police Record Checks
  • Academic Conduct Report

After Filing Documents with the Board

Memos handed out, when lodging the Notice of Intention, will outline dates for start and end of payment periods.

There are two fees. A composite fee of $322.50 and Admission Library Fee of $560.00.
