New rules for registering New Zealand judgments

From 1 October 2017 amendments will be introduced to Order 7A of Chapter 1 of the Rules to clarify the procedure for registration of New Zealand judgments in the Court under the Trans–Tasman Proceedings Act 2010 (Cth). The Rules clarify that there is no need to issue an originating motion. An application is made by filing the relevant form from the Commonwealth Regulations with the Prothonotary together with the accompanying material.

The amendments also remove the requirement for a summons to be issued in respect of applications under the Act which do not require notice to be given.
