Judgment summary - Timbercorp Finance Pty Ltd (In liq) v Collins and Tomes [2016] VSCA 128

The Court of Appeal has dismissed an appeal by Timbercorp Finance Pty Ltd (in liq) concerning the rights of group (proceedings) members to raise defences in later debt recovery proceedings. The Court of Appeal held that it was not unreasonable for those parties not to have raised their individual claims in the group proceedings and they were not precluded from relying on their defences in later proceedings.
