Refunds

It is possible to make an application for a refund of Court Fees in certain and limited circumstances. All applications are considered on their merit, although in most cases are only considered favourably where genuine mistakes or duplications have occurred. Court Fees are not refunded due to a matter settling after the fee was paid or because of a change of mind.

All applications are to be made by completing the Refund Revenue Form, providing proof of payment (for example, a receipt) and any other supporting documentation of the application. The Refund Revenue Form can be obtained from the Registry.

Application for Fee Waiver

Pursuant to s.129(3) of the Supreme Court Act 1986, the Prothonotary may exercise his discretion to waive a prescribed fee for a person to whom, in his opinion, the payment of that fee would cause financial hardship.

Please note that this provision only applies to individuals and a fresh application form will need to be completed each time a waiver is sought.

There are no fees payable in criminal matters.
