Court of Appeal Registry
Location
The Court of Appeal Registry is located on the Ground Floor of the Old High Court Building, 450 Little Bourke Street, Melbourne. The Registry is responsible for the processing of all criminal and civil appeals and applications for leave to appeal to the Court of Appeal.
The Court of Appeal is situated at 459 Lonsdale Street, Melbourne.
The Green Court is located on the Ground Floor.
The Red Court is located on Level 1
The Blue Courtis located on Level 2
Hours
The Registry is open to the public from 9.30am to 4.00pm, excluding public holidays and the Tuesday following Easter Monday.
Filing an Appeal
Practitioners seeking to file an appeal should have regard to the Court of Appeal Practice Notes, the time limits for appeal, the Supreme Court General Civil Procedure Rules and the Criminal Appeals and Procedure Rules.
Applications and Notices should be prepared and served on the relevant Court of Appeal Forms.
Criminal Appeals - Time Limits
Convicted persons have 14 days from the day the Order is made to file an appeal.
An appeal to the Court of Appeal against a conviction or sentence is commenced by filing with the Registrar:
(a) a Notice of Appeal; or
(b) a notice of application for Leave to Appeal.
If the time for giving Notice of Appeal or notice of application for Leave to Appeal has expired, then a notice of application for extension of time shall be filed as well as the Notice of Appeal or Notice of application for Leave to Appeal. In most cases it is probably appropriate to file an Affidavit setting out the reasons for the delay.
Civil Appeals - Time Limits
Appeals are governed by strict rules and an extension of time must be sought from the Court of Appeal if the Appeal is not commenced within time.
Notice of Appeal / Application for Leave to Appeal must be served upon every Respondent:
- 14 Days after decision or judgment from Supreme and County Courts
- 28 Days after the day of the Order for Appeals from VCAT
Appellant must file with the Registrar of the Court of Appeal within seven days after service of the Notice of Appeal on the Respondent:
- Notice of Appeal
- List of Parties upon whom the Notice of Appeal has been served
Appellant must file with the Registrar of the Court within seven days after expiration of the time to serve Notice of Appeal:
- A Note of Proposed Contents of Appeal Book
If Note of proposed contents of the Appeal Book is not received within time, the appeal is deemed abandoned.
