Video Conferences
Introduction
There are various situations in which the need to conduct an audio visual link or audio link might arise. These include a witness giving evidence from a remote location, the appearance of a party before a Court, the making of submissions to a Court, proceedings involving children and the appearance of an accused person in specified proceedings.
The Evidence Act 1958 ["the Act"] sets out the various requirements for the conduct of an audio visual link and audio link. The requirements in relation to persons other than an accused person are dealt with in Division 2 of Part IIA. The requirements in relation to an accused person are dealt with in Division 3 of Part IIA. Important general requirements are set out in Division 4 of Part IIA.
Requirements
An order of the Court to use the video conferencing facilities is required. If the case has been listed for trial and a Judge has not been allocated, applications for an order should be made to the Listing Master.
Before an order is obtained, the Video Conference Co-ordinator should be notified of the tentative date and time of the link.
The responsibility for booking the remote site facility for the witness is solely the responsibility of the applicant and they must ensure the Court has all the necessary information to link up.
