As part of the Supreme Court of Victoria’s move to a paperless future, electronic filing for the Taxation list, Arbitration list and Admiralty list in the Commercial Court will be enabled from Tuesday, 2 January 2018.
From this date, all new proceedings for these lists are to be commenced using the Court’s RedCrest electronic filing system. Proceedings initiated prior to 2 January 2018 will continue as hard copy files.
To support electronic filing in these lists, the following Rules and Practice Notes have been updated:

|2 September 2016||Today we launched a re-modelled Commercial Court web page. The revised page not only includes the information which was on the previous web page, but also provides a significant amount of additional information which should be of assistance for parties and their legal practitioners when dealing with the Commercial Court. In particular, the web page addresses many of the 'commonly asked questions' asked by parties and legal practitioners. Information is also ordered more logically and under convenient headings with drop down detail to avoid a cluttered appearance.|

From 25 August 2016, Victorian Taxation Appeals are to be initiated and managed in the Commercial Court Taxation List. Similarly, any other proceeding in which a substantial issue is raised in respect of taxation, including taxation recovery and disputes with respect to goods and services tax (but excluding professional liability claims against tax professionals or advisors), are to be initiated and managed in the Commercial Court. The existing fee structure will, for present purposes, continue to apply.
Practitioners are encouraged to file all taxation proceedings in the Commercial Court Registry.

From 1 July 2016, the Commercial Court Judge-managed Lists will be re-modelled to enhance efficiencies in case management, accuracy of listings, data completeness and ease of use by the legal profession. Under the changes, General Commercial Court Lists A-E will be retired and existing matters in these Lists will be administratively transferred to the relevant managing Judge. Commercial Court matters not currently entered into Lists A-E but which are being managed by Commercial Court Judges will also be transferred to the relevant managing Judge. The relevant Notice to the Profession can be viewed here.
In order to promote an efficient approach to the management of insurance disputes, the Commercial Court will also establish an Insurance List commencing 1 July 2016. Justice Hargrave will be the Judge-in-Charge of the List.
|29 June 2016||A Notice to the Profession has been issued advising that from 29 June 2016 professional liability claims against taxation professionals or advisors should no longer be issued in the Commercial Court Taxation List. Instead, such matters are to be initiated and managed in the Common Law Professional Liability List. The Notice can be viewed here.|
|28 August 2015||Practice Note 13 of 2015 (published on 28 August 2015), reinstates the Oppression Pilot introduced under Practice Note 5 of 2014 - Oppression Proceedings, and applies to proceedings commenced on and from 1 September 2015 until 1 August 2016. The Practice Note can be viewed here .|
