Form 64A is for use in civil proceedings in the Court of Appeal – it is used to commence an application for leave to appeal, an appeal, a cross-application for leave to appeal and a cross-appeal

Most civil proceedings in the Court of Appeal are commenced by filing an application for leave to appeal or notice of appeal in accordance with Form 64A, together with other required documents. There are time limits on appealing a decision to the Court of Appeal and leave to appeal is required in most cases.

Other documents required to be filed at the same time as the Form 64A are:

  • Written case of no more than 10 pages.
  • List of authorities with pinpoint references.
  • Copy of the authenticated order sought to be appealed.
  • Copy of the written reasons of the court or tribunal in respect of which the application for leave to appeal or appeal is made.
  • Draft application book index.
  • Draft summary for the Court of Appeal of no more than 10 pages.

The Form 64A must be signed.

Form 64A is also used to commence a cross-application for leave to appeal or cross-appeal. In those circumstances, a written case of no more than 10 pages and list of authorities with pinpoint references must be filed at the same time.

A Form 64A will not be accepted for filing unless the applicable filing fee has been paid.
