Template summary for use in civil proceedings in the Court of Appeal

This template summary is for use in civil proceedings in the Court of Appeal. It should be used when preparing a draft summary for the Court of Appeal that is to be filed at the same time as an application for leave to appeal.

The purpose of the summary is to assist the Court to quickly understand the background and issues. The contents must be stated in a neutral manner.

The summary must not exceed 10 pages and must contain the following sections:

A.        Summary of facts

B.        Summary of proceedings and issues

The Court expects parties to work co-operatively and endeavour to agree upon the summary.

Parties must not file separate summaries. If the summary is not agreed, the Registrar of the Court of Appeal may dispense with it. Accordingly, when drafting their written case, parties should not assume that the summary, or their preferred version of it, will be included in the material before the Court.
