A judge may make an order referring the matter to mediation if the judge thinks that mediation may assist the parties to resolve their dispute.

An order referring a matter to mediation may be made at any time the matter is before the court. The mediation order can be made at an early stage or even during the final hearing .

A party to a dispute may also apply to the court for an order that the matter, or part of the matter, be referred to mediation.
