Determining who is entitled to share in an estate can be complex, and in Victoria is determined by the intestacy provisions in the Administration and Probate Act 1958 (Vic). The questions that will be asked, and the example affidavit paragraphs provided, are by way of information and assistance only. You must make sure any statement included in your application is accurate, and correctly reflects the relationships of the deceased at the date of their death. The questions and information provided applies only to deaths on or after 1 November 2017.
