The purpose of this questionnaire is to assist in determining who should make an application for administration where someone dies without a valid will, and what information needs to be provided in support of the application.  You can find out more about the process to make an application for administration in our step by step guide.  

Determining who is entitled to share in an estate can be complex, and in Victoria is determined by the intestacy provisions in the Administration and Probate Act 1958 (Vic).  The questions that will be asked, and the example affidavit paragraphs provided, are by way of information and assistance only.  You must make sure any statement included in your application is accurate, and correctly reflects the relationships of the deceased at the date of their death.  The questions and information provided applies only to deaths on or after 1 November 2017.  For any deaths prior to this date, or if you are uncertain who is entitled to make an application or share in a deceased's estate, you are encouraged to obtain legal advice.
