Form 64B is for use in civil proceedings in the Court of Appeal

An interlocutory application in a civil proceeding in the Court of Appeal (such as for an extension of time, a stay of an order, security for costs or for the Court to receive further evidence) is made by filing an application other than for leave to appeal in accordance with Form 64B, together with other required documents.

Other documents required to be filed at the same time as the Form 64B are:

  • Affidavit in support.
  • Submissions in support of no more than 5 pages.
  • List of authorities with pinpoint references (note: this is not required if the application is for an extension of time).
  • Draft application book index (note: this is not required if the application is for an extension of time).

A Form 64B will not be accepted for filing unless the applicable filing fee has been paid.
