Notice to the Profession

The Acting Chief Justice has authorised the issue of the following notice.

Arrangements on the passing of Her Majesty Queen Elizabeth II and the Proclamation of the Sovereign His Majesty King Charles III

1   Condolences

The Acting Chief Justice Emerton today signed the condolence book at Government House paying respect to Her Majesty Queen Elizabeth II on behalf of members of the Court past and present and expressing gratitude for her long years of service.

2    Proclamation of the Sovereign and Title of Proceedings

The Acting Chief Justice Emerton and the Hon Justice Priest today attended the ceremony at Government House for the Proclamation of the Sovereign His Majesty King Charles III.

In accordance with s 11(2) of the Constitution Act 1975 current proceedings commenced in the name of the Queen will be carried on in the name of the King.

There is no need for practitioners to seek orders or re-file any court documents bearing the previous title or re-swear any affidavits bearing the previous title. Future court documents should be prepared reflecting the new title.

3    National Day of Mourning

With the announcement of the public holiday on 22 September 2022 this will now be a non-sitting day. Parties will be advised of arrangements for individual matters that were listed that day.

Urgent applications may be made under the usual public holiday arrangements. Juries in deliberations may continue to sit at the direction of the presiding Judge.
