This case is an application for leave to appeal against sentence in relation to one count of armed robbery and one count of theft. The facts of the case are set out in the judgment of the lower Court below.
In regard to disadvantage and principle in Bugmy v The Queen  HCA 37, it should be noted there has been a subsequent decision of the Supreme Court in DPP v Herrmann  VSCA 160 which provides a more detailed discussion.
