Template list of authorities for use in civil proceedings in the Court of Appeal

This template list of authorities is for use in civil proceedings in the Court of Appeal. It must contain the following parts (if there are no authorities to include in a particular part, state ‘None’):

A.        Cases and legislation to be read from at a hearing (being cases or legislation it is intended to read out to the Court during oral submissions)

B.        Cases and legislation to be referred to but not read from at a hearing (being cases or legislation that are relied upon, but which it is not intended to read out to the Court during oral submissions)

C.        Textbooks and journal articles (being any textbooks or articles which the party considers may be of substantial assistance to the Court)

Where a case has been published in an authorised report, the citation for the authorised report version must be given.

Pinpoint references must be provided. For each case, state the specific paragraph(s) or page(s) relied upon. For all legislation (including Acts, regulations and court rules), state the specific section(s), regulation(s) or rule(s) relied upon. For any textbooks or journal articles, state the specific paragraphs(s) or page(s) relied upon.

All authorities must be referenced in accordance with the current edition of the Australian Guide to Legal Citation.
