This Notice to the Profession relates to a new cross-divisional specialist list for the management of commercial and retail lease matters.

The Chief Justice has authorised the issue of the following notice.

Establishment of Commercial and Retail Leases List

A new cross-divisional Commercial and Retail Leases List has been established to promote an efficient approach to the management of commercial and retail lease disputes. It will commence to operate from 4 April 2022.

The Judge-in-Charge of the Commercial and Retail Leases List is Justice M Osborne.

The following matters will be included in the Commercial and Retail Leases List:

  • First instance proceedings, within the Court’s jurisdiction, concerning disputes about commercial and retail leases.1 These proceedings should be filed on RedCrest in the Commercial Court selecting “Commercial Court (Judge Managed)” in the Case Type field and “Commercial and Retail Leases” in the Initiating Action field;
  • Appeals under section 148 of the Victorian Civil and Administrative Tribunal Act 1998 (Vic) and judicial review applications in relation to decisions of the Victorian Civil and Administrative Tribunal concerning commercial and retail lease disputes. These proceedings should be filed on RedCrest in the Common Law Division selecting “Common Law (Judicial Review and Appeals)” in the Case Type field and “Commercial and Retail Leases” in the Initiating Action field.
