A judgment in relation to the COVID-19 State Government Group Proceedings was handed down on 2 December 2021.

DETAILS

A two-day  in the COVID-19 State Government (Business Losses) Group Proceeding (S ECI 2020 03402) and the COVID-19 State Government (Personal Injury) Group Proceeding (S ECI 2020 03598) was held on Monday, 31 May 2021 and Tuesday, 1 June 2021.

The hearing arose from applications by the State of Victoria that:

  • each proceeding should be summarily dismissed on the ground that the plaintiffs’ claims have no real prospect of success; or
  • alternatively, the plaintiffs’ pleading in each proceeding be  on the ground that they do not disclose a cause of action.

 in relation to these applications was handed down by the Honourable Justice John Dixon of the Supreme Court of Victoria on 2 December 2021.
