The Court of Appeal hearing in the matter of David Thurin & Anor v Krongold Constructions (Aust) Pty Ltd & Ors will be live streamed on Thursday 1 September and Friday 2 September.

The Court of Appeal will hear the matter of David Thurin & Anor v Krongold Constructions (Aust) Pty Ltd (ACN 103 839 149) & Ors (S EAPCI 2022 0051), commencing on Thursday, 1 September 2022 at 10.15am and continuing on Friday, 2 September 2022 at 10.15am.

By order dated 22 June 2022, Justice Peter Riordan, sitting as a member of the panel of judges appointed pursuant to s29(1) of the VCAT Act, referred several questions of law arising in the VCAT proceeding of David Thurin & Lisa Thurin v Krongold Constructions (Aust) Pty Ltd & Ors to the Court of Appeal.

It is these questions of law that are the subject of the Court of Appeal hearing commencing on Thursday 1 September. The case concerns a building dispute about construction of a house in Toorak.

The questions of law concern the interpretation of s76(ii) of the Constitution, including whether VCAT can hear cases where a party is a corporation.
