The Victorian Government has released a Regulatory Impact Statement (RIS) on proposed changes to some Probate Office fees.

The RIS contains information about the proposed changes, outlining three possible options, the rationale, and considerations.

The Supreme Court of Victoria’s civil fees – including Probate Office fees – are set by government regulations; the Probate Office in the Supreme Court is responsible for collecting those fees in relation to applications made for probate or administration. 

The Court is not a participant in the review of the fees, other than providing information to government about the operation of the Probate Office for the purpose of their review.

The government is inviting public feedback on the RIS at Engage Victoria. Submissions close on 19 July 2024.

There will be no changes to fees for applications lodged by either members of the public or the legal profession until the government has completed their review and made any new regulations.
