An accused charged with murder, issued a subpoena on the Chief Commissioner of Victoria Police seeking material which might establish a defence of self-defence. The Chief Commissioner claimed Public Interest Immunity, arguing that the material relates to matters of state. The Court inspected the material and concluded that public interest in not disclosing it outweighs the public interest in disclosure to the defence.
