The Court of Appeal delivered its judgment in this matter on 18 December 2020.

GENERAL INFORMATION 

The Court of Appeal (the Honourable Justices David Beach, Stephen Kaye and Robert Osborn) delivered its judgment in the matter of Roman Catholic Trusts Corporation for the Diocese of Sale v WCB on 18 December 2020. 

The matter concerned an application filed on behalf of the Roman Catholic Trusts Corporation for leave to appeal a judgment of the Trial Division of the Supreme Court of Victoria in WCB v Roman Catholic Trusts Corp for the Diocese of Sale, handed down by the Honourable Justice Andrew Keogh on 30 September 2020.   

The September decision was the first ruling on amendments made to the Limitation of Actions Act 1958 (Vic) by the Children Legislation Amendment Act 2019 (Vic).  Justice Keogh made orders on 12 October 2020, and the application for leave to appeal was filed on behalf of the Roman Catholic Trusts Corporation on 20 November 2020. 

APPLICATION FOR LEAVE TO APPEAL 

The Court of Appeal heard the application for leave to appeal on 8 December 2020 and handed down its judgment on 18 December 2020. 

In its judgment, the Court of Appeal found that the Roman Catholic Trusts Corporation had failed to establish any of its grounds for appeal, and the application for leave to appeal was refused.
