The Court of Appeal (Justice Phillip Priest, Justice Stephen Kaye and Justice Kim Hargrave) has delivered its judgment in the matter of Osman Shaptafaj v The King.

The applicant in this matter pleaded guilty to the murder of his daughter and her husband. On 22 February 2022, he was sentenced to life imprisonment on each charge. The judge fixed a non-parole period of 35 years.

The applicant sought leave to appeal his sentence in the Court of Appeal. Additionally, as the application for leave to appeal was not filed until 31 May 2022, after the expiration of the period fixed for the filing of such an application, the applicant also made an application for an extension of time (within which to file the notice of an application for leave to appeal).

In handing down its judgment on 27 April 2023, the Court of Appeal allowed the application for an extension of time, but refused the application for leave to appeal against sentence.
