A three-day hearing in the matter of Marjorie Thorpe v Head, Transport for Victoria & Ors (S ECI 2020 04091) was held before the Honourable Justice Jacinta Forbes of the Supreme Court of Victoria on 31 May, 1 June and 2 June 2021.

The matter concerns a challenge to the construction of and/or completion of part of the Western Highway Duplication – Section 2B Buangor to Ararat project.

Justice Forbes handed down her decision in relation to an application for an interlocutory injunction in this matter on Thursday, 3 December 2020, following hearings conducted on 19, 20 and 23 November 2020.

The hearing that ran from Monday, 31 May concerned two applications:

  • an application by the plaintiff to amend her statement of claim
  • an application by the first to fourth defendants for summary dismissal or a striking out of some or all of the claims.
