This is a group proceeding (class action) brought on behalf of persons who placed one or more bets using Sportsbet’s ‘Fast Code service’ from 24 December 2018 to 24 December 2024, and lost more money than they won.
Under the Interactive Gambling Act 2001 (Cth) (IGA), placing a bet on a sporting event after it has commenced is unlawful in Australia, unless the bet is made wholly by telephone. It is alleged that Sportsbet’s Fast Code service contravenes the IGA as it allowed customers to input key information about the bet via the Sportsbet app and/or website, rather than by telephone.
It is alleged that Sportsbet has engaged in misleading and deceptive conduct by representing that the Fast Code service was legal and by breaching its Fast Code service terms and conditions, which stated that Sportsbet complies with the IGA in not accepting live betting via the internet but may do so via telephone. Sportsbet denies the allegations.
