This form is used only when directed by the Probate Office.
The Probate Office will usually direct you to use this form where the Registrar of Probates has determined that the Court should decide the application. This may occur if there is doubt about whether a grant of representation should be made.
For example, you may be directed to file this form on RedCrest-Probate where an application is made to prove an informal will, the value of the estate exceeds $3 million, and consent for the Registrar to exercise the powers of the Court cannot be obtained.
Hearing date
When completing the form, you must include a return date for directions.
The return date must be a List directions day that is at least 28 days after the date the notice is filed.

You do not need to request a hearing date from the Court before filing this notice.

The first hearing is usually for directions only. The Court will not usually decide the final outcome at that hearing.
