This affidavit should be completed by a person who is familiar with the deceased's handwriting or signature and can explain how they became familiar with it.
This template may be used where information is needed to confirm that the signature appearing on a will is the deceased's signature.
Examples of situations where this evidence may be required include:
- an affidavit of due execution cannot be obtained from either witness who signed the will and no other person is available to provide evidence about the signing of the will;
- a document appears to have been signed by the deceased as a will, but no other person was present when it was signed; or
- the Probate Office has requested evidence about the signature appearing on the will.
The template asks for information about:
- how the person became familiar with the deceased's handwriting or signature;
- whether they personally saw the deceased sign documents;
- documents containing signatures known to be those of the deceased;
- similarities between those signatures and the signature appearing on the will; and
- the reasons the person believes the signature on the will is the deceased's signature.
The template is designed to assist a person who is familiar with the deceased's handwriting or signature to provide evidence about why they believe the signature on the will belongs to the deceased.
