AFL Racism Group Proceeding (Class Action)

This is a group proceeding (class action) brought by Phillip Brent Krakouer against the Australian Football League (AFL). 

The claim alleges that Mr Krakouer and the other group members experienced racism, racial vilification, racial discrimination, racial abuse, racial violence or victimisation (the ‘racism conduct’) during their time participating in the AFL competition. Mr Krakouer alleges that he suffered injury, loss and damage as a result of the racism conduct. 

The proposed group members to this proceeding are persons who are Aboriginal or Torres Strait Islander people and/or people of colour, who played in the AFL competition between 1975 and 2022, and persons who were/are in close relationships with those players. 

The group proceeding is being run by Margalit Injury Lawyers on a ‘no win no fee’ basis. There is currently no third party litigation funder involved in this group proceeding. 
 

Important information about registration and opting out

If you are, or you think that you may be a group member, you should read the documents below carefully. The definition of a "group member" is set out in the Notice.

The Notice (a copy of which is below) contains important information about your rights to do one of the following: 

1. sign up to the class action
2. do nothing
3. opt out.

In summary, if you fall within the definition of a group member, you have three options:

Option 1 – Sign up

Group Members who sign up with Margalit Lawyers will be bound by the result of the class action. If the class action is successful, you will be entitled to share in any compensation money received. You may need to meet certain requirements and provide information (including medical reports to explain your injury) before your claim can be assessed.

To sign up, you must by 4pm (AEDT) on 2 November 2026:

• ring Margalit Lawyers on (03) 9133 0288;
• complete the online registration form with Margalit Lawyers; or
• complete the Registration Form found on page 8 of the Notice and return via email or post to the address on the notice for Margalit Lawyers.

Option 2 – Do nothing

If the class action settles before the start of the trial of the class action, unless the Court makes a different order, group members who do not sign up or opt out:

• cannot take part in any settlement
• cannot claim a share of any compensation money
• are bound by the settlement and you may lose your legal rights to make further legal claims against the AFL about the matters covered by this class action.

Option 3 – Opt out

If you do not want your rights determined by the class action you must opt out by 4pm (AEDT) on 2 November 2026.

To opt out, you must complete the opt out form found on page 9 of the Notice and return via email or post to the address on the notice for the Registry of the Supreme Court of Victoria.
