This is a group proceeding (class action) brought against Melbourne Water on behalf of persons who were leaseholders of property at the Rivervue Retirement Village, Avondale Heights, Victoria, and suffered loss and damage following the flooding of the Maribyrnong River on 14 October 2022.
The proceeding alleges that Melbourne Water was negligent in its flood modelling and development approval of finished floor height levels, which caused the Rivervue Retirement Village to flood and resulted in significant damage to the properties.
Melbourne Water Corporation has filed a third party notice against the company it consulted for flood modelling (GHD Pty Ltd) and joined Moonee Valley City Council as the second defendant in the proceeding pursuant to section 24AL(1) of the Wrongs Act 1958 (Vic).
The group proceeding is being conducted by Mayweathers and William Roberts Lawyers and is being funded by LLS Australia Funding Pty Ltd.
