This matter is a group proceeding (class action) brought on behalf of persons that were, or commenced to be, a franchisee in the United Petroleum network and were a guarantor of a franchisee’s obligations between 19 October 2016 to 20 October 2022. The proceeding is brought against United Petroleum Franchise Pty Ltd (United Petroleum) and Avi Silver, a director of United Petroleum. 

The claim alleges that United Petroleum engaged in misleading and deceptive conduct and unconscionable conduct, and contravened obligations under the Franchising Code, franchise agreements and Oilcodes with respect to the installation of the Pie Face franchise and allocation of Pie Face stock into United Petroleum sites, without the consent of franchisees. The claim alleges that the Plaintiffs and group members have suffered loss and damage as a result of the conduct.
