This group proceeding is brought on behalf of persons who had surgery performed on them by one of the following doctors:

  • Dr Daniel Lanzer
  • Dr Daniel Aronov
  • Dr Daniel Darbyshire
  • Dr Ryan Wells, and/or
  • Dr Alireza Fallahi

Or surgery performed on them at one of the following medical clinics, pursuant to a contract with Dermatology & Cosmetic Surgery Services Pty Ltd:

  • 30-32 Glenferrie Road, Malvern, Victoria
  • 3/276-278 Pitt Street, Sydney, New South Wales
  • 11 Hayling Street, Salisbury, Queensland, and/or
  • 1A/1 Roydhouse Street, Subiaco, Western Australia.

The plaintiff alleges misleading or deceptive conduct and breach of statutory guarantees under the Australian consumer protection laws and negligence, and that she suffered loss or damage as a result.

IMPORTANT INFORMATION ABOUT REGISTRATION OPTING OUT

If you are, or you think that you may be a group member, you should read the documents below carefully. 

The Notice (a copy of which is below) contains important information about your rights to: 

(1) register your claim in the proceeding; or 
(2) opt out of the proceeding.

In summary, if you fall within the definition of a group member, you have three options:

  • If you want to be eligible claim money from any settlement reached between the plaintiffs and the defendants to settle the class action at any point up until the day prior to the commencement of trial, you must register your claim in accordance with the Notice by 4:00pm (AEST) on 10 April 2026.
    • To register, you must either:
      • complete the online registration form with Maddens Lawyers; or
      • complete the registration form found at Schedule 1 of the Notice and submit by email or post to the address for Maddens Lawyers stated on the form.
        For further information on how to register, please refer to Option 1 on page 4 of the Notice below.
         
  • If you do not want your rights determined by the class action you must opt out by 4:00pm (AEST) on 10 April 2026.
    • To opt out, you must either:
      • complete the online opt out notice; or
      • complete the opt out notice found at Schedule 2 of the Notice and return via email or post to the address on the notice for the Registry of the Supreme Court of Victoria. 
        For further information about opting out, please refer to Option 3 on page 5 of the Notice below.
         
  • If you do nothing in response to the Notice, then if there is a settlement of the class action by 14 August 2026, the Plaintiffs intend to apply to the Court for an order which if approved by the Court means you will not be permitted to claim a share of the settlement payment as compensation for your injury or loss without leave of the Court. Only Group Members who have registered will be permitted to claim compensation from a settlement by 14 August 2026.
