The Court will livestream what could be Australia’s largest class action from October 5.
More than 8 million people are estimated to be impacted by Jeremey Clarke v JB Hi-Fi Group Pty Ltd (S ECI 2023 05830).
This class action, also known as a group proceeding, was brought on behalf of those who purchased extended warranties (also called Extended Care, Extra Care or Customer Care) from JB Hi-Fi Group Pty Ltd between 1 January 2011 and 8 December 2023.
It is alleged that JB Hi-Fi engaged in misleading or deceptive conduct, or unconscionable conduct, by representing to consumers purchasing goods from them that the extended warranties offered longer coverage and additional benefits to the statutory guarantee that consumers already have under the Australian Consumer Law.
The lead plaintiff and group members seek compensation for purchasing the extended warranties which they allege were of little or negligible value.
JB Hi-Fi denies the substance of the claims against it.

Unless you submitted an opt out notice earlier this year, you are considered a class/group member if you bought an extended warranty from JB Hi-Fi in-store or online any time between 1 January 2011 and 8 December 2023, even if you have a made a claim under the warranty or if the warranty has expired.
The trial before Justice Jim Delany is expected to run for 6 weeks, with hearings starting from 10am each day.
