As the deceased was domiciled outside of Victoria the personal estate of the deceased is to be distributed in accordance with the laws of intestacy in the jurisdiction the deceased was domiciled.  This may be different to the laws that apply in Victoria, so we cannot provide any guidance on who may be entitled to share in the estate or who should make an application.  You are encouraged to obtain legal advice.

When filing your application, along with the usual affidavit in support, you will need to file an affidavit from a legal practitioner competent to practice in the jurisdiction where the deceased was domiciled stating who would be entitled to share in the estate according to the laws of intestacy in that jurisdiction as it applies to the deceased’s situation.
