Group Proceeding (class action) brought on behalf of dairy farmers who, during the 2015-2016 season, supplied milk to any of Fonterra Australia Pty Ltd, Fonterra Milk Australia Pty Ltd or Fonterra Brands (Australia) Pty Ltd (referred to together as “Fonterra”).
The claim alleges that Fonterra breached the contractual obligations they owed to their milk suppliers by implementing a price decrease (sometimes called a “step down”) in May 2016, that Fonterra engaged in misleading conduct about the likelihood of a step down in 2016 and acted unconscionably towards suppliers. The claim seeks financial compensation from Fonterra for the group members.

On 15 November 2022, the Court approved a Notice of Proposed Settlement to be sent to group members. Group members should read the notice carefully as the matters set out in the notice may affect their legal rights.
The notice requires that group members who wish to claim compensation must complete the online Claim Form before 27 January 2023. The notice contains a website link to the online Claim Form.
The notice also requires that any group member who wishes to object to the proposed settlement must download and complete the Objection Form and send it to the Supreme Court (at the address shown on the form) before 27 January 2023.
